Abstract

This article aims to analyze and define the scope of jurisdiction of the Electoral Court, proposing a doctrinal redefinition of the scope of jurisdiction of Electoral Justice, especially in light of recent court decisions. The article applies, methodologically, the literature of the traditional doctrine of the Electoral Law, Constitutional and Procedural, as well the relevant legislation and case law. It starts doing a review of the functions of the Electoral Justice from the point of view of the constitutional and infra-constitutional norms on the competence of the Electoral Court. It shows that, since the judgments of “ADIN's 3999 / DF and 4086 / DF”, and in the light of constitutional principles, the case law of TSE and ordinary legislation should be admitted as sources valid, in exceptional and subsidiary basis as standards of competence of the Electoral Court. It shows that the competence of the Electoral Court is much broader than the traditional doctrine and jurisprudence has recognized, not only based on the judgment of ADIN's referred to, but also based on the Electoral Code and other laws. It demonstrates, in conclusion, that there is no basis to limit the jurisdiction of Elections to acts and events that occurred only during the "electoral process" or have impacts on them. Finally, aims to demonstrate, also in conclusion, that the Electoral Court must be understood also as a Justice of the Partisan Questions.

Será facultado ao autor apresentar novamente texto anteriormente submetido e não aceito para publicação, desde que realizadas as adaptações sugeridas no parecer anônimo enviado pela EJE/TSE. Não serão admitidos recursos.
