Abstract
The present text analyzes the problem of female underrepresentation in Brazilian politics, from the perspective of a qualitative approach and descriptive methodology, analyzing the evolution of the subject,
from the institution of women’s right to vote, to the present moment, in which the affirmative action constituted in the gender quota exists, however, it still does not produce the expected effects. It also addresses the attempted fraud to the quota, its consequences before the legislation and the Electoral Courts, pointing out the need for rigor in the judicial assessment of the subject, to curb such fraud and allow full democracy to be achieved, with the participation of women in areas of power, for the benefit of all society.
